Service provision change (“SPC”) under regulation 3(1)(b) dominates the recent caselaw. However, it is easy to forget that SPC can also amount to a traditional transfer of an undertaking, and there are some cases where employees are only protected under the traditional model of transfer of undertakings (regulation 3(1)(a)) as opposed to SPC.
This seminar provides a refresher on the main principles and cases concerning regulation 3(1)(a), together with a practical application of key TUPE concepts in an interactive and informative workshop.
